Furthermore, you warrant and grant Vermilion Vitez LLC the right to provide your information without recourse to these providers so that they may fulfill your contract. Any recourse of action or unsatisfactorily provided services will attempt to be mediated by Vermilion Vitez LLC, but ultimately it is your responsibility to work it out with your contractor. Additionally, you indemnify Vermilion Vitez LLC and guarantee to hold harmless Vermilion Vitez LLC in all actions performed in recommending subcontractors performed in good faith.

Litigation Against Us

Any member who initiates litigation against us connected with our products, information, or services implicitly consents to pay any and all fees, costs, and attorney fees incurred by us in defending the suit, and to do so as the fees are incurred rather than at the end of such litigation. This is especially true in the case of any civil or criminal prosecution in connection with our purely First Amendment activities and materials. Instead, Clients/Customers consent to binding arbitration as described in the section below.

Governing Law & Arbitration

These Terms of Service, and any dispute arising out of or relating to them, your order, or any product or service we provide, are governed by the laws of the State of Florida, without regard to its conflict-of-laws principles.

Any such dispute will be resolved by binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules (including that Rules’ cost-shifting protections for you as the consumer), before a single arbitrator, seated in Florida. Judgment on the arbitration award may be entered in any court of competent jurisdiction. This arbitration agreement does not stop us from seeking injunctive relief in court to protect our intellectual property or confidential information, or from taking action in small claims court for a qualifying individual dispute.

Arbitration under this section proceeds only on an individual basis. You and Vermilion Vitez LLC each waive any right to bring or participate in a class, collective, or representative action against the other, and each waive any right to a jury trial.

Approach Toward Violent, Illegal, Harmful, or Criminal Activity

Please also note that Vermilion Vitez LLC does not condone the use of violent, illegal, criminal, or harmful activities as a viable means of resolution to problems. If such violent, illegal, criminal, or harmful activities are being implemented, this organization and its contractors, subcontractors, and agents will not be available to help you.

In short, education and knowledge will prevail. If you want to help institute change, then teach your neighbor. Most people strive to do right when they know the facts. Teach them, educate them, show them compassion. It is misinformation, ignorance, and apathy that work as a tool against us. We strive to allow each man and woman to make the choices for themselves. When violence, illegal activities, harm, or crime is implemented, you are removing choice and have become what you strive to change.

Vitezmail Acceptable Use

Vitezmail (vitezmail.com) is our email, calendar, and document platform, and these Terms of Service apply to it in full. This section adds Vitezmail-specific rules; see also the Vitezmail section of our Privacy Policy for how we handle your mail and account data.

You agree not to use Vitezmail to send spam, unsolicited bulk email, malware, phishing, or any other abusive or illegal mail. Each mailbox is subject to a sending-rate limit, and account creation is limited and monitored by network to prevent abuse. We monitor delivery signals — such as bounces and spam complaints — associated with outgoing mail to protect deliverability for all Vitezmail users.

We may throttle, suspend, or terminate any Vitezmail account, without notice, that we reasonably believe is being used to violate this section, and may report abusive activity to relevant authorities or infrastructure providers. Vitezmail is intended for users 18 and older.
