Whether that holds up in practice depends on your state's law, when the transfer happened, who serves as trustee, and how the trust is actually administered afterward — a trust that exists on paper but is run like a personal bank account tends not to be treated as separate. We teach how these structures are meant to work and prepare the documents; whether one is appropriate for your situation is a question for a licensed attorney.
Timing is the single biggest factor, and this is the most common mistake we see. Moving assets into a trust after a lawsuit has been filed, after a debt has matured, or once a claim is reasonably foreseeable can be challenged as a fraudulent or voidable transfer, and courts can unwind it. Protection planning is meant to be done while the sky is clear. If you already have a claim against you, speak with a licensed attorney before transferring anything.
A revocable trust can be amended or dissolved by you at any time. That flexibility is useful for avoiding probate and organizing an estate, but because you keep control, the assets are generally still treated as yours. An irrevocable trust generally cannot be unilaterally changed once established — and that surrender of control is precisely what creates the separation people are usually after. The trade-off is real, which is why we walk through it before any document is drafted.
This is where a lot of trusts fall apart. The more control you retain — naming yourself trustee, keeping unrestricted power over distributions, treating trust property as your own — the easier it is for someone to argue the trust and you are the same thing. Structures that are meant to create genuine separation usually involve an independent trustee and real limits on the grantor. We explain those trade-offs plainly so you understand what you would actually be giving up.
They do different jobs. An LLC is built to contain liability arising from the business activity inside it, so a claim against the company does not automatically reach you personally. A trust is about ownership, succession, and privacy — who holds the thing and what happens to it later. Many people eventually use both, with a trust owning the entity rather than replacing it. We tell people to form the entity first, run it cleanly, and revisit trusts once there is something meaningful to hold.
